Adarand Constructors, Inc. v. Pena, (1995)

A lawsuit brought by Adarand Constructors, Inc. (website) against United States Secretary of Transportation Federico Peña, decided by the US Supreme Court in 1995.
The ruling held that all racial classifications whether imposed for the benefit of minorities or not, must be analyzed by a reviewing court under a standard of "strict scrutiny," the highest level of Supreme Court review (such classifications are constitutional only if they are narrowly tailored measures that further compelling governmental interests). Justice Sandra Day O'Connor wrote the majority opinion of the Court, effectively changing the standard set in Metro Broadcasting, Inc. v. FCC, (1990), in which the Court had created a two tiered system for analyzing racial classifications.
Co-Plaintiff Valery Pech Orr
Co-plaintiff Valery Pech Orr became Executive Director of the Colorado Civil Rights Initiative website (CoCRI) on April 23, 2007, as part of Ward Connerly's "Super Tuesday of Equality" project targeting 5 states for ballot initiatives in 2008. Pech Orr also spoke at the announcement of the Michigan Civil Rights Initiative (MCRI) on July 8, 2003.
